The Council of Guardianship of the Imperium (Caphiric Latin: Concilium Tutelae Imperialis), often contracted to the Council of the Imperium, represents the central executive authority within the Government of Caphiria. The Council consists of two principal components: the Office of the Imperium, led by the Imperator and includes the Prime Minister (who serves as the President of the Council) and a suite of non-magisterial officials tasked with assorted administrative responsibilities; and the Council of Ministers, a collective of ministers appointed by the Imperator upon the Prime Minister's suggestion, forming the operational nucleus of The Imperium's governance framework. Additionally, the Council includes various non-magisterial officials such as deputy ministers (viceministri), junior ministers (sottosegretari), among others.

Under the Constitution, the Imperator is the chief executive of the executive branch and leads the Office of the Imperium, the main organ of the executive power. The Imperator governs by way of his imperium maius (supreme executive power) and delineates authority through the Council's hierarchy, channeling responsibilities through the Prime Minister and the ministers. The Prime Minister's appointment is a ceremonial endorsement by the Imperator following extensive consultations and is ratified by a comprehensive vote spanning the Corcillum, Caphiria's parliament. Subsequently, based on the Prime Minister's nominations, the Council of Ministers is assembled to mirror the government's administrative and policy-oriented objectives.

The Council of the Imperium is often contracted to "The Imperium" and is often used metonymically to refer to the entirety of Caphiria's government, not only emphasizing the Council's central executive authority, but also but also reflecting the intricate balance maintained between direct democratic representation, the valor of meritorious service, and the concentrated executive power wielded by the Imperator.

Organization

The Council of The Imperium consists of:

  • The Office of the Imperium
    • The Imperator, as head of state and of the executive branch of the government;
    • The Prime Minister, the chair of the council, who is appointed by the Imperator after consultations and is confirmed by a vote of both houses of parliament;
    • Non-magisterial officials such as the numerarius (who keeps records of national finances); the adjutores (assistants to the Imperator); the magister equitum (organizer of the Imperator's transportation), etc.
  • The Council of Ministers
    • The Ministers, appointed by the Imperator, according to the request of the Prime Minister.

Functions

As the central organ of the executive power, the Council's primary role is to actualize national political decisions. The Constitution provides it with the following means of doing this:

Legislative initiative: The Council of the Imperium can present bills to the national parliament.

Decree power: The Council of the Imperium can adopt two different types of the decree with legal force (that is, with a legal power equivalent to laws passed by the Senate): the Decree-law in cases of urgency and the Legislative decree in cases where the Senate has expressly delegated legislative authority to the Council. Frequent use of the decree power has seen substantial legislative power shift from the Senate to the Council.

Regulatory power: The ministers have two distinct but co-existing roles. They are politically the supreme executive authorities appointed by the Senate, but they are also the administrative heads of the State, whose activities they direct by the political process. As administrators, the Council and the individual ministers can produce "regulations" (regolamenti), which are legal implements subordinate to legislation. Thus, regulations that contradict legislation (i.e., laws passed by parliament, decree-laws, legislative decrees) are illegitimate and can be set aside by ordinary judges and annulled by administrative judges.
