The National Audit Council is the judicial branch of the Government of Faneria. Despite being the highest court in Faneria, the NAC does not act as a final arbiter on appeals, which are handed down to High Courts; instead, it is tasked with the management of the court system and the power of judicial review, as well as being the body primarily responsible for impeachments within the Cananachist structure of government.

Structure and Membership

The NAC consists of seven members selected from among the existing pool of judges by the Director of the Republic prior to end-of-year approval by the National Assembly; Auditors being elected upon the death or term-end of a previous member. If no proposed candidates are approved by popular vote in the Assembly, the remaining Auditors are permitted to elevate a judge of their choice.

Within the Council, the most senior Auditor holds the title of Auditor-General, controlling proceedings within the assembled court. Three of the remaining six Auditors are elected internally to the positions of Speakers to the NEAC, the Assembly, and the Public, with the former two attending meetings of their respective areas of appointment and the latter being responsible for press relations. The lesser three Auditors typically handle ceremonial roles outside of Council rulings, namely advising the High Courts and directing national level anticorruption efforts.

Constitutional Rulings

Precedent for legal cases is typically set by the rulings of Provincial or High Courts, but the National Audit Council interacts directly with the system of precedents in the Faneria in three ways. In addition to being able to independently subject executive and legislative proceedings to judicial review, Auditors may by a majority vote strike legal precedents as unconstitutional or elevate provincial-level precedents to the national level with a unanimous vote.

Impeachment of Government Officials

The NAC acts as the jury of impeachment cases involving National-level elected officials such as the Director or Assemblymen. In the case of an Auditor being impeached, the NAC is required to abide by the rulings of the High Court of Civil Impeachment, which normally handles cases filed against unelected state officials.
